MBX Membership Terms & Conditions & Use Agreement
Effective Date: January 1st, 2026
This Membership Terms & Conditions and Use Agreement (“Agreement”) is entered into by and between MBX (“MBX,” “we,” “us,” or “our”) and the individual or entity purchasing a membership (“Member,” “you,” or “your”).
By purchasing a membership and accessing the MBX facility located at 1330 N St, Lincoln, NE 68508, you agree to be bound by the terms outlined below.
1. Membership Access & Term
Memberships are valid for 12 months from the date of purchase, unless otherwise stated.
Memberships grant access to MBX facilities and services in accordance with the rules (See Appendix A)
Membership benefits, access hours, and usage limits are subject to change at MBX’s discretion with notice
2. Space Usage & Reservations
Members are permitted up to 16 hours of usage on site per month.
All time must be reserved in advance through the members-only portal and attached calendar on the MBX website using the Member’s login credentials.
Monthly usage hours reset each calendar month and do not roll over.
Members are responsible for adhering to all reservation times and leaving promptly at the end of their scheduled session. (there are no buffers between sessions)
Members can use the space for Recording, Rehearsal, and Performance, with full access to the studio, sound system, video wall, and lighting
Public performances are limited to 4 Per Year, and must be approved by MBX Staff (See Appendix B)
MBX Membership does not include producers, sound or lighting engineers, or staffing during your sessions. We do have a list of engineers we trust to run the gear, so don’t hesitate to reach out through the discord channel to find someone to assist in your sessions.
3. Member Responsibilities
Members agree to:
Use the facility and equipment responsibly and for lawful purposes only
Follow all posted rules, instructions, and staff guidance
Leave the space clean, orderly, and ready for the next user
Not allow non-members access to the facility without prior written approval from MBX
Not share login credentials or access privileges
4. Damage, Loss, & Financial Responsibility
Members are fully financially responsible for any damage, loss, or destruction of MBX property, equipment, furnishings, or facilities caused by:
The Member
Any guests or collaborators accompanying the Member
MBX reserves the right to charge the Member for:
Repair costs
Replacement costs
Cleaning fees
Loss of use
Payment for damages must be made upon demand and may be charged to the payment method on file.
5. Assumption of Risk
Member understands that use of recording studios, musical equipment, and facilities involves inherent risks.
Member voluntarily assumes all risks associated with use of the MBX facility, including but not limited to:
Personal injury
Property damage
Equipment malfunction
Hearing-related risks
6. Release of Liability & Waiver
To the fullest extent permitted by law, Member agrees to:
Release, waive, and hold harmless MBX, its owners, employees, contractors, and affiliates from any claims, damages, injuries, or losses arising from use of the facility
This includes claims resulting from ordinary negligence, but not from gross negligence or willful misconduct
7. Indemnification
Member agrees to indemnify, defend, and hold harmless MBX from any claims, liabilities, damages, costs, or expenses (including reasonable attorney’s fees) arising from:
Member’s use of the facility
Violation of this Agreement
Actions of the Member or their guests
8. Conduct & Termination
MBX reserves the right to suspend or terminate a membership without refund if a Member:
Violates these Terms & Conditions
Damages property
Engages in unsafe, disruptive, or unlawful behavior
Fails to comply with staff instructions
9. No Refunds
Membership fees are non-refundable, including in cases of suspension or termination due to policy violations.
Unused time does not entitle the Member to credits or refunds.
10. Website Access & Credentials
Members must log in to the MBX website using credentials created during signup to access gated content and booking tools.
Members are responsible for maintaining the confidentiality of their login credentials.
11. Modifications to Agreement
MBX reserves the right to update or modify these Terms & Conditions at any time. Continued use of the facility after changes constitutes acceptance of the updated terms.
12. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Nebraska.
APPENDIX A: RULES
1. DO NOT TAKE ANYTHING FROM THE SPACE. We exist to support the musicians in our community, and the equipment on site is critical to the success of everyone involved. We all need to trust that the equipment we need is there when we arrive. The cameras inside and out of the space, along with the detailed timestamp of your member number will help ensure the safety of the equipment and those responsible for it.
2. THE MEMBER WHO HAS BEEN APPROVED AND ONBOARDED BY MBX MUST BE ON-SITE FOR THEIR SESSIONS. The onboarding process is so important, and the person with the membership is held responsible for whatever happens during their timeslot. Please be thoughtful about the guests you bring with you.
3. SHOW THE UTMOST RESPECT TO THE SPACE, THE EQUIPMENT, AND OTHERS AROUND YOU. If you are careless with gear, the space, and our neighbors, we will not tolerate disrespect and you will be asked not to return. Do not stay past your allotted timeslot, and make sure the equipment is in the default state when you leave.
4. NO ILLEGAL SUBSTANCES OR ACTIVITIES.
APPENDIX B: Public Events
Each MBX Member can book 4 public events per year. These events must be approved by MBX Staff and must adhere to the rules outlined in Appendix A, in addition to the following special rules.
An event is considered public if it is open to the general public. If someone who is walking by is welcome to enter the space, and the East door is open to anyone, then it is considered a Public Event. Private events, by invitation only, are not in this category and therefore are not required to adhere to this special set of rules.
Special Public Performance Rules:
You must pay or provide a sound engineer for the duration of the event. You CANNOT leave the mixing console unsupervised.
You must pay or provide someone to run security at the door
No alcoholic beverages
All MBX events are ALL-AGES events and must accommodate accordingly
The MBX Member who booked the event MUST perform in it. This can be in an opening-act capacity or the headliner
A reminder that you, the member, are responsible for anything that happens onsite to equipment and to the space itself, so please be mindful of this.
